Terms of Service

These Terms of Service (“Terms”) govern your use of Donyus CRM (“Donyus,” “we,” “us,” or “our”), a B2B SaaS platform operated at donyuscrm.com. By creating an account or using the platform, you agree to these Terms.

1. Eligibility

Donyus CRM is designed for construction businesses and their authorized representatives. You must be at least 18 years old and have the authority to bind your company to these Terms. By using Donyus, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at mundo@sub-cess.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

3. Free GC Pipeline Sandbox

The Free GC Pipeline Sandbox (“Sandbox”) is a self-serve tracking board provided at no cost. The Sandbox includes a pipeline board for up to 25 deals and anonymized industry benchmarks. It does not include email sending, outbound campaigns, automations, AI features, integrations, customizations, or any form of support.

By using the Sandbox, you grant us permission to use your deal data (contract values, square footage, project types, follow-up counts, and outcomes) in anonymized, aggregated form to create industry benchmarks. No company names, email addresses, or personally identifiable information will be included in benchmarks.

The Sandbox is provided “as is” without guarantees of uptime, data accuracy, or availability. We may modify, suspend, or discontinue the Sandbox at any time without notice.

4. The Service

Donyus CRM provides tools for managing general contractor relationships, email communications, deal pipelines, and project documents. Features include:

• Contact and deal management
• Gmail integration for reading, sending, and organizing emails
• Google Drive integration for project folder and document management
• Outbound campaign management and tracking

We may update, modify, or discontinue features at any time. We will make reasonable efforts to notify you of material changes.

4. Google Account Integration

When you connect your Google account, you authorize Donyus to access your Gmail and Google Drive data as described in our Privacy Policy. You can revoke this access at any time from your Donyus account settings or from your Google Account permissions page. Our use of Google data complies with the Google API Services User Data Policy, including the Limited Use requirements.

5. Your Data

You retain ownership of all data you upload or generate through Donyus, including contacts, deal information, and documents. We do not claim any ownership rights to your data. You grant us a limited license to use your data solely to provide and improve the service.

6. Acceptable Use

You agree not to:

• Use Donyus for any purpose that violates applicable laws or regulations
• Send spam, unsolicited bulk email, or messages that violate the CAN-SPAM Act or similar legislation through the platform
• Attempt to gain unauthorized access to other users’ accounts or our systems
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use the platform in a way that could harm, disable, or impair the service for other users

7. Payment and Billing

Paid plans are billed according to the pricing agreed upon at the time of enrollment. You authorize us to charge your payment method on a recurring basis. If payment fails, we may suspend access to your account until the balance is resolved. You may cancel your subscription at any time by contacting us.

8. Limitation of Liability

To the maximum extent permitted by law, Donyus and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

Donyus CRM is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that it will meet all of your requirements.

10. Termination

Either party may terminate this agreement at any time. You may delete your account by contacting us at mundo@sub-cess.com. We may suspend or terminate your account if you violate these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the platform. Your continued use of Donyus after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts of Florida.
